Terms and Conditions

Welcome to the Terms and Conditions of Use (these “Terms”). This is a legally binding contract between you and the platform operator registered in the United Arab Emirates (“Company,” “we,” “us,” “our,” or the “App”). Please review these Terms thoroughly before using the App. By downloading, registering for, or using the App, you agree to be legally bound by these Terms, our Community Guidelines, and our Privacy Policy.

1. Eligibility, Registration & Immutable Gender Preferences

1.1 Age & Legal Capacity
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to create an account. By registering, you confirm that you have the legal capacity to enter into this contract under the laws of the United Arab Emirates and the country in which you reside, and that you have not been convicted of any felony, sexual offense, or cybercrime.

1.2 Account Integrity
You agree to provide accurate, truthful, and up-to-date information, including your real identity and age. Creating fake accounts, using unauthorized third-party credentials, or sharing account access is strictly prohibited and constitutes a violation of UAE digital identity regulations.

1.3 Immutable Gender Filter Protocol

• Your target gender preference (target_gender) is selected strictly during initial account creation.
• Permanence: Once selected, this preference is permanent, immutable, and cannot be bypassed or modified during user sessions.
• Strict Binary Enforcement: The platform engine strictly isolates matching feeds (profiles seeking men interface exclusively with male accounts; profiles seeking women interface exclusively with female accounts) with zero queue crossover or algorithmic fallback under any inventory conditions.

2. Community Guidelines & Proactive Content Moderation (UAE Compliance)

The platform enforces strict community safety standards in accordance with UAE Federal Decree-Law No. 34 of 2021 on Countering Rumours and Cybercrimes and national public decency policies.

2.1 Prohibited Content & Behavior
You agree not to post, send, transmit, or solicit any content across the following categories:

• Prohibited Content & Commercial Solicitation:
  • Any form of nudity, sexually explicit material, vulgar language, or content offending public decency and morals.
  • Commercial sex work, escort arrangements, "sugar baby/daddy" relationships, paid dates, or financial solicitation.
  • Unauthorized commercial promotion, business advertising, third-party payment handles, or off-platform money transfers.
• Harassment, Defamation & Body Shaming:
  • Direct insults, physical appearance shaming, vulgar commentary, or intimidation.
  • Threats of harm, extortion, blackmail, or non-consensual disclosure of personal details or photographs (doxing).
  • Hate speech, sectarian remarks, or discrimination based on race, nationality, religion, disability, gender, or social status (in compliance with Federal Decree-Law No. 34 of 2023 on Combating Discrimination and Hatred).
• Inauthenticity, Scams & Impersonation:
  • Catfishing, using altered or stolen images, or misrepresenting personal identity or qualifications.
  • Financial scams, cryptocurrency promotion, investment solicitations, or fraudulent schemes.
  • Unsolicited attempts to force conversations to external messaging platforms for fraudulent exploitation.

2.2 Automated Moderation & Sender Safety Alerts

• Messages containing verified policy violations are blocked instantly prior to delivery.
• The sender receives an immediate Safety Alert Banner explaining the specific standard violated.
• Egregious violations or repeated offenses will result in immediate profile termination, and, where mandated by UAE law, notification to competent law enforcement and regulatory authorities.

3. Matching Mechanics, Capacity Limits & Discovery Rules

3.1 Concurrency Limits & Slot Recycling
To promote meaningful interaction and prevent match hoarding, the App enforces hard concurrency limits:

• Active Matches Limit: You may maintain a maximum of 50 active matches at any given time. Reaching 50 matches pauses new matching across Discovery and Auto Connect until an existing match is removed, automatically freeing up a new match slot.
• Active Open Conversations Limit: You may have a maximum of 8 open, active chat conversations at any one time. Initiating a new conversation is locked until an existing thread is closed or unmatched, opening a conversation slot.

3.2 Discovery Window & Preferences Toggle

• When "Apply Preferences to My Matches" is ON: The Discover deck strictly enforces all saved age, distance, and pillar criteria.
• When "Apply Preferences to My Matches" is OFF: The Discover deck relaxes optional criteria and presents all active profiles matching your immutable target gender preference.

3.3 Wiz Window & Compatibility Scoring

• The Wiz feed surfaces profiles dynamically based on the user-selected Compatibility Barometer threshold slider.
• Compatibility is calculated across active core pillars (Values, Lifestyle, Communication). Profiles that meet or exceed the selected threshold are displayed. Unselected attributes or "Any" wildcard defaults are excluded from scoring calculations to ensure score accuracy.

3.4 Inactive Match Status Notice
If a match has not logged in for 48 hours or more, or exhibits an average response latency exceeding 24 hours, the chat header will display an ambient notice:
“{match_name} is prioritizing themselves right now. They’ll be back once they’re ready.”

4. Artificial Intelligence Features & Disclaimers

4.1 Blindpod AI Mentor

• Non-Medical / Non-Psychological Disclaimer:
  THE AI MENTOR IS AN AUTOMATED INTERACTIVE TOOL DESIGNED SOLELY FOR INFORMAL CONVERSATIONAL REFLECTION AND ENTERTAINMENT. IT DOES NOT CONSTITUTE MEDICAL, PSYCHOLOGICAL, OR THERAPEUTIC ADVICE, CLINICAL DIAGNOSIS, OR CRISIS COUNSELING.
• Emergency Crisis Protocol: The AI Mentor cannot address mental health emergencies or immediate personal safety risks.

4.2 "Notes" AI Chat Summary (Premium Tier)

• Premium subscribers receive access to the "Notes" summarizer, generating a standardized 4-sentence overview of conversation topics, shared rapport, and re-engagement angles.
• Trigger Conditions: Activates exclusively on discussions containing more than 100 messages OR threads that have been inactive for more than 72 hours.
• Daily Quota: Limited to exactly 1 Golden Discussion summary per calendar day (resets at 00:00 UTC).

5. In-App Purchases, Subscriptions & Payment Terms

5.1 Payment Processing via App Stores
All financial transactions, subscriptions, and digital purchases are processed exclusively through official third-party app stores (Apple App Store & Google Play Store). The Company does not directly collect, process, or store credit card details.

5.2 Subscription Plans & Exclusive Add-Ons

• Base Premium Membership: Available in weekly or monthly tiers ($10 USD / week), unlocking enhanced discovery filters, unblurred inbound likes, and the daily "Notes" AI Golden Discussion summary.
• Privacy Suite Add-On ($20 USD / week): Global Incognito Browsing, Selective Reveal milestone unlocking, and field-level profile visibility controls.
• Unlimited Connection Boost ($25 USD / week): Continuous top-of-deck profile amplification across Discover and Wiz queues.

5.3 Auto-Renewal & Cancellation
All recurring subscriptions renew automatically until cancelled directly within your Apple ID or Google Play settings at least 24 hours prior to renewal.

5.4 Refunds
Refund processing is managed directly by Apple and Google under their respective store policies.

6. Data Privacy & Intellectual Property

6.1 Data Privacy (UAE PDPL Compliance)
The Company collects and processes personal data in strict compliance with Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (UAE PDPL).

6.2 Intellectual Property Rights
All proprietary software code, design assets, algorithms, and branding belong exclusively to the Company and are protected under UAE Federal Decree-Law No. 38 of 2021 on Copyrights and Neighbouring Rights.

7. Disclaimers of Warranties & Limitation of Liability

7.1 "As-Is" Provision
The App, matching mechanisms, and AI tools are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

7.2 Personal Interaction Disclaimer
You are solely responsible for your interactions and offline meetings with other members.

7.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE UAE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THE COMPANY’S TOTAL AGGREGATE LIABILITY SHALL BE LIMITED TO THE AMOUNT PAID BY YOU IN THE SIX (6) MONTHS PRECEDING THE EVENT, OR AED 350, WHICHEVER IS GREATER.

8. Governing Law & Dispute Resolution

8.1 Governing Law
These Terms shall be governed by and construed in accordance with the Federal Laws of the United Arab Emirates.

8.2 Dispute Resolution & Arbitration

• Informal Settlement: Written notice to legal@blindpod.com for thirty (30) days.
• Arbitration (DIAC): Resolved under the Arbitration Rules of the Dubai International Arbitration Centre (DIAC). Seat: Dubai, UAE. Language: English.

9. TERMINATION & SURVIVAL

You may delete your account at any time via Settings > Account > Delete Account. Sections 2, 4.1, 6, 7, and 8 shall survive termination.
